NL - ALGEMENE VOORWAARDEN (scroll down for English)

Artikel 1 – Definities

  1. Gasseling Coaching, gevestigd te Veldhoven, KVK-nr 90362284
  2. Klant/coachee: iedere natuurlijke persoon of rechtspersoon die gebruik maakt van diensten of producten van Gasseling Coaching.
  3. Overeenkomst: iedere afspraak tussen partijen over coaching, workshops, familieopstellingen of productaankoop.
  4. Diensten: alle door Gasseling Coaching aangeboden sessies, coachtrajecten, opstellingen en aanverwante begeleiding.
  5. Producten: fysieke artikelen zoals kaartjes en tekeningen.

Artikel 2 – Toepasselijkheid

  1. Deze algemene voorwaarden zijn van toepassing op alle aanbiedingen, overeenkomsten, leveringen en diensten van Gasseling Coaching.
  2. Afwijkingen zijn alleen geldig indien schriftelijk overeengekomen.

Artikel 3 – Prijzen

  1. Alle prijzen zijn in euro’s, inclusief BTW (0% op basis van KOR), exclusief eventuele verzend- en administratiekosten.
  2. Gasseling Coaching mag prijzen te allen tijde wijzigen, met schriftelijke kennisgeving voorafgaand aan inwerkingtreding.

COACHING & OPSTELLINGEN

Artikel 4 – Betaling en facturatie

  1. Bij het inplannen van een traject ontvangt de Klant direct een factuur voor een aanbetaling. Deze aanbetaling dient te worden voldaan om de plek te reserveren. Het resterende bedrag wordt voldaan volgens de afgesproken betalingsregeling vóór of tijdens het traject.
  2. Bij het inplannen van een eenmalige opstelling of coaching-sessie:
    • Sessies binnen 2 weken: de Klant ontvangt direct een factuur die uiterlijk op de dag van de afspraak voldaan dient te zijn.
    • Sessies verder in de toekomst (>2 weken): de Klant kan een aanbetaling ontvangen; het volledige bedrag dient uiterlijk op de dag van de afspraak voldaan te zijn.
  3. Indien de factuur op de vervaldatum niet is voldaan, verkeert de Klant automatisch in verzuim en kan Gasseling Coaching de afspraak opschorten totdat volledige betaling heeft plaatsgevonden.

Artikel 5 – Annulering coaching of opstellingen

  1. De Klant kan een afspraak tot uiterlijk 24 uur voor aanvang kosteloos één maal verplaatsen. Hiervoor dient altijd per e-mail contact opgenomen te worden met Gasseling Coaching. De ontvangstbevestiging is leidend.
  2. Restitutie van reeds betaalde sessies of trajecten vindt niet plaats, ook niet indien de afspraak tijdig wordt verplaatst.
  3. Bij annulering of verplaatsing binnen 24 uur voor aanvang worden de volledige kosten van de sessie in rekening gebracht en vindt geen restitutie plaats.
  4. Bij voortijdige beëindiging van een traject is Gasseling Coaching geen terugbetaling verschuldigd voor nog niet opgenomen sessies.

Artikel 6 – Duur van de overeenkomst

De overeenkomst geldt voor de duur van het traject of de geboekte sessie, tenzij schriftelijk anders is overeengekomen.

PRODUCTEN

Artikel 7 – Betaling producten

  1. Producten worden uitsluitend verzonden na volledige betaling.

Artikel 8 – Herroepingsrecht producten

  1. De Klant heeft een wettelijke bedenktijd van 14 dagen na ontvangst van het product, tenzij:
    • het product op maat is gemaakt;
    • het product reeds is gebruikt, of;
    • hygiënische verzegeling is verbroken.
  2. De Klant meldt een retour via info@lindagasseling.com.
  3. Retourzendingen zijn voor rekening en risico van de Klant.

Artikel 9 – Levertijd & verzending

  1. Vermelde levertijden zijn indicatief en kunnen niet als fatale termijn worden aangemerkt.
  2. Gasseling Coaching verzendt zorgvuldig. Eventuele transportschade moet direct bij de vervoerder worden vastgelegd.

ALGEMEEN

Artikel 10 – Informatieverstrekking

De Klant staat in voor juistheid en volledigheid van alle informatie die nodig is voor uitvoering van de dienst.

Artikel 11 – Aansprakelijkheid en disclaimer

  1. Coaching en familieopstellingen vervangen geen medische of therapeutische behandeling. De Klant blijft altijd zelf verantwoordelijk voor zijn eigen fysieke en mentale gezondheid.
  2. Gasseling Coaching is niet aansprakelijk voor fysieke of psychische klachten die ontstaan tijdens of na deelname aan een familieopstelling of coachingstraject.
  3. Aansprakelijkheid is volledig uitgesloten, behalve in geval van opzet of grove schuld.
  4. Indien aansprakelijkheid geldt, is deze beperkt tot maximaal het factuurbedrag van de betreffende dienst of levering.

Artikel 12 – Geheimhouding

Partijen houden alle vertrouwelijke informatie geheim, tenzij er een wettelijke verplichting bestaat tot openbaarmaking.

EN - TERMS & CONDITIONS 

Article 1 – Definitions

  1. Gasseling Coaching, registered in the Netherlands, Chamber of Commerce no. 90362284
  2. Client/coachee: any natural or legal person who makes use of services or products of Gasseling Coaching.
  3. Agreement: any arrangement between parties regarding coaching, workshops, family constellations or product purchases.
  4. Services: all sessions, coaching programmes, constellations and related guidance provided by Gasseling Coaching.
  5. Products: physical items such as cards and drawings.

Article 2 – Applicability

  1. These general terms and conditions apply to all offers, agreements, deliveries and services of Gasseling Coaching.
  2. Deviations are only valid if agreed in writing.

COACHING & CONSTELLATIONS

Article 3 – Pricing

  1. All prices are listed in euros, including VAT (0% based on the KOR scheme), and excluding any shipping or administrative costs.
  2. Gasseling Coaching may change prices at any time, with prior written notification before the changes take effect.

Article 4 – Payment and invoicing

  1. When booking a coaching programme, the Client receives an invoice for a deposit. This deposit must be paid in order to secure the reserved place. The remaining amount must be paid according to the agreed payment schedule, before or during the programme.
  2. When booking a single constellation or coaching session:
    • Sessions within 2 weeks: the Client receives an invoice immediately, which must be paid no later than on the day of the appointment.
    • Sessions scheduled more than 2 weeks ahead: the Client may receive an invoice for a deposit; the full amount must be paid no later than on the day of the appointment.
  3. If the invoice is not paid by the due date, the Client is automatically in default and Gasseling Coaching may suspend the appointment until full payment has been made.

Article 5 – Cancellation of coaching or constellations

  1. The Client may reschedule an appointment once free of charge up to 24 hours before the start time. Rescheduling must always be requested by email; the confirmation of receipt by Gasseling Coaching is binding.
  2. Refunds for paid sessions or programmes do not take place, even if rescheduled on time.
  3. If an appointment is cancelled or rescheduled within 24 hours before the start time, the full session fee will be charged and no refund will take place.
  4. In case of early termination of a coaching programme, Gasseling Coaching is not obliged to refund any unused sessions.

Article 6 – Duration of the agreement

The agreement is valid for the duration of the booked session or coaching programme, unless agreed otherwise in writing.

PRODUCTS

Article 7 – Payment for products

  1. Products are only shipped after full payment has been received.

Article 8 – Right of withdrawal for products

  1. The Client has a statutory 14-day withdrawal period after receiving the product, unless:
    • the product has been custom-made;
    • the product has been used; or
    • the hygienic seal has been broken.
  2. The Client shall report a return via info@lindagasseling.com.
  3. Return shipments are at the Client’s own cost and risk.

Article 9 – Delivery & shipping

  1. Stated delivery times are indicative and are not considered strict deadlines.
  2. Gasseling Coaching ships products with due care. Any transport damage must be reported to the carrier upon receipt.

GENERAL

Article 10 – Information provided by the Client

The Client guarantees the accuracy and completeness of all information required for the execution of the service.

Article 11 – Liability and disclaimer

  1. Coaching and family constellations are not a substitute for medical or therapeutic treatment. The Client remains fully responsible for their own physical and mental health.
  2. Gasseling Coaching is not liable for physical or psychological complaints arising during or after participation in a constellation or coaching programme.
  3. Liability is fully excluded, except in cases of intent or gross negligence.
  4. If liability applies, it is limited to the invoice amount of the specific service or product to which the liability relates.

Article 12 – Confidentiality

Both parties shall keep all confidential information strictly private, unless disclosure is required by law.
